Early Access Terms

These Early Access Terms ("Early Access Terms") govern your access to and use of beta, early access, alpha, preview, experimental, or limited-availability features, products, or services ("Early Access Features") made available by Frontal Labs, Inc. ("Frontal," "we," "us," or "our"). These Early Access Terms supplement the Terms of Service. By accessing or using Early Access Features, you agree to these terms. Capitalized terms not defined here have the meanings given in the Terms of Service.

1. NATURE OF EARLY ACCESS FEATURES

1.1 Early Access Features are pre-release, experimental, or limited-release features that we make available to gather feedback, test functionality, assess market interest, and improve the Services. Early Access Features may be incomplete, may not have been fully tested, and may contain bugs, errors, or design flaws.

1.2 Early Access Features are identified as "beta," "alpha," "early access," "preview," "experimental," "limited availability," "pilot," "labs," or similar designation in the Services interface, Documentation, or communications.

1.3 We may modify, limit, or discontinue Early Access Features at any time without notice or liability. We have no obligation to make Early Access Features generally available or to continue developing them.

2. ACCESS AND USE

2.1 Access to Early Access Features is by invitation or opt-in only. We may limit the number of users or organizations that may access Early Access Features.

2.2 We grant you a limited, non-exclusive, non-transferable, revocable right to access and use Early Access Features during the Early Access period solely for internal evaluation and testing purposes.

2.3 You must not:

Use Early Access Features in production environments or for production workloads without our prior written consent.
Disclose, publish, or publicly discuss Early Access Features (including their existence, functionality, performance, or limitations) without our prior written consent, unless publicly disclosed by us.
Benchmark, test, or compare Early Access Features against other products or services without our prior written consent.
Provide access to Early Access Features to any third party without our prior written consent.

3. FEEDBACK

3.1 You agree to provide feedback regarding Early Access Features when reasonably requested. Feedback may include bug reports, feature suggestions, usability observations, performance assessments, and other information about your experience.

3.2 You grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up license to use, modify, distribute, and incorporate into our Services any feedback, suggestions, ideas, or recommendations you provide regarding Early Access Features. This license survives termination of these Early Access Terms.

3.3 We may reference your participation in Early Access programs in our marketing materials, provided we do not disclose your Confidential Information or Customer Data without your consent.

4. FEES

4.1 Early Access Features are provided at no charge unless otherwise communicated. We may introduce Fees for Early Access Features upon general availability. If Fees are introduced during the Early Access period, we will provide at least 30 days' notice.

4.2 If Early Access Features are made generally available and you continue using them after the general availability date, standard pricing applies unless you have a separate agreement.

5. CONFIDENTIALITY

5.1 Early Access Features, including their existence, functionality, design, performance characteristics, documentation, and any information we provide about them, are our Confidential Information under the Terms of Service.

5.2 Your confidentiality obligations regarding Early Access Features survive termination of these Early Access Terms and continue until the Early Access Feature is publicly released as generally available.

6. NO WARRANTY

6.1 EARLY ACCESS FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
THAT EARLY ACCESS FEATURES WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
THAT EARLY ACCESS FEATURES WILL MEET YOUR REQUIREMENTS OR BE SUITABLE FOR ANY PURPOSE.
THAT ERRORS OR DEFECTS WILL BE CORRECTED.

6.2 The warranty provisions in the Terms of Service and any Order Form do not apply to Early Access Features.

7. NO LIABILITY

7.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRONTAL WILL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING FROM OR RELATING TO EARLY ACCESS FEATURES, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.2 The indemnification obligations in the Terms of Service and any Order Form do not apply to Early Access Features. Frontal has no obligation to indemnify, defend, or hold you harmless for claims arising from your use of Early Access Features.

8. NO SLA

Early Access Features are excluded from all service level commitments, including the Service Level Agreement and Enterprise Service Level Agreement. No uptime, availability, performance, support, or response time commitments apply.

9. NO DATA PROCESSING COMMITMENTS

9.1 Our Data Processing Agreement applies to Early Access Features only to the extent that the DPA is technically applicable given the nature of the Early Access Feature.

9.2 We do not guarantee that Early Access Features implement the full set of security controls, encryption standards, backup procedures, or data protection measures described in our security and data protection policies.

9.3 We may delete or reset all data stored in or generated through Early Access Features at any time, including upon termination of the Early Access period, without notice or liability. You must not store data in Early Access Features that you cannot afford to lose.

10. TERM AND TERMINATION

10.1 The Early Access period for a Feature continues until the earlier of: (a) the date we discontinue the Early Access Feature; (b) the date the Early Access Feature becomes generally available; or (c) the date we terminate your access.

10.2 We may terminate your access to any Early Access Feature at any time without cause and without liability.

10.3 Upon termination: (a) your access to the Early Access Feature ends; (b) all data stored in the Early Access Feature may be deleted; and (c) Sections 3 (Feedback), 5 (Confidentiality), 6 (No Warranty), 7 (No Liability), and this Section 10.3 survive.

10.4 Upon general availability of an Early Access Feature, your continued use is governed by the Terms of Service and applicable product-specific terms.

11. GENERAL

These Early Access Terms are governed by the same law and dispute resolution provisions as the Terms of Service. If any provision of these Early Access Terms conflicts with the Terms of Service, these Early Access Terms control with respect to Early Access Features.
